Vacant Foreclosed Property Ordinance
The Vacant Foreclosed Property Ordinance,
FMC section 10-620 was approved by Fresno City Council to establish a Vacant Foreclosed Property Registration program that requires Bank / Lender owned property to be secure and maintained to limit the negative effects these properties have on our neighborhoods. The vacant foreclosed property ordinance specifically addresses vacant properties that have come under the control of a trustee or beneficiary as a result of the default of the borrower and/or the foreclosure process. The ordinance also applies to properties where the deed of trust was transferred to the beneficiary of a deed of trust involved in the foreclosure, and any properties transferred under a deed in lieu of foreclosure.

This ordinance applies to All Properties, Commercial and Residential currently In the Foreclosure Process, and under Bank/Lender control.
What are the time frames for registering these vacant foreclosed properties?
Bank/Lenders have 10 business days to inspect defaulting properties and to provide a completed foreclosed property registration form to the Code Enforcement Division.
Where can I obtain a registration form, and what is the cost to register a property in foreclosure?
The Registration Form can be obtained by clicking here, or by contacting the Code Enforcement Division at 559-621-8400. Currently, there is no cost for the first initial registration of a property.
Who is responsible for completing the registration form?
The trustee or beneficiary of the property, Bank/Lender, or Agent acting in behalf of trustee/lender.
What information is required for the Vacant Foreclosed Property registration form?
Name, address and telephone number of trustee and/or beneficiary, address and parcel number (APN) of the vacant property, name address of responsible property Management Company, and the name and address and telephone number of all known lien holders and/or individuals with ownership interest in the property.
Why register these vacant foreclosed properties?
The Vacant Foreclosed Property Ordinance registration process requires a bank/lender responsible for a property in foreclosure to not only register the property, but the ordinance also requires the legal owner(s) to maintain all yards and landscaping, keep the property secured and free of trash, debris and Graffiti.
What if the property is vacant, but not currently in foreclosure?
Properties that are Vacant, but not in foreclosure, are enforced under the existing Vacant Building Ordinance (FMC 9-811).
Once I have completed the registration form, what is next in the process?
The completed registration form can be faxed, sent as an attachment via Email, or mailed to the Code Enforcement Division, at 2600 Fresno Street, Room 3070, Fresno, CA 93721-3605.
